These Terms of Service (“Terms”) govern your use of our website and the sale of products by Condom Covers (ABN: 90 552 045 534). By placing an order you agree to these Terms.
1. Important information & acceptance
You must be 18 years or older to purchase. By ordering you confirm you are 18+. We may require age verification.
2. Ordering & acceptance
All orders are subject to availability and acceptance by us. After you place an order you’ll receive an order confirmation; acceptance occurs when we send a dispatch/shipping confirmation. We reserve the right to refuse or cancel orders (including where pricing errors occur).
3. Pricing & GST
Prices shown are GST inclusive. If we are registered for GST, applicable sales to Australian customers include 10% GST. If you are outside Australia you are responsible for any import duties, taxes or local charges.
4. Payment
We accept payment through our chosen payment providers (Shopify Payments, Stripe, PayPal or similar). Your payment will be processed by the payment provider — we do not store raw card details. Additional payment terms are governed by the payment provider’s terms and Shopify’s terms.
5. Shipping & risk
Shipping options, delivery estimates and costs are shown at checkout. Risk in goods passes to you on delivery. Title passes on full payment. See our Shipping Policy for details (linked).
6. Consumer guarantees & returns (ACL)
Your statutory rights are not limited by these Terms. Under the Australian Consumer Law (ACL) you have guarantees (goods of acceptable quality, match description, etc.). If goods fail to meet consumer guarantees you are entitled to a remedy (repair, replacement or refund) depending on the situation. Our Return & Refund Policy describes how we handle returns and refunds.
7. Change of mind & hygiene-sensitive items
Because of the intimate nature of some items we may limit returns for hygiene reasons. Items returned for change of mind must be unopened, unused and in original condition unless otherwise agreed. See our Return & Refund Policy.
8. Intellectual property
All content on the site (trademarks, logos, images, text and design) is owned or licensed by us. You may not copy or use our IP except as permitted in writing.
9. Prohibited conduct
You must not use the site for unlawful purposes, attempt to interfere with systems, upload offensive content, or resell in breach of these Terms.
10. Liability & disclaimers (limited)
To the maximum extent permitted by law, our liability for any loss or damage is limited. Nothing in these Terms attempts to exclude or restrict your rights under the ACL which cannot be excluded (e.g., certain consumer guarantees). The ACCC has published guidance on consumer guarantees and businesses must not mislead consumers about those rights.
11. Indemnity
You indemnify us against claims arising from your misuse of the site or breach of these Terms.
12. Privacy & marketing
Our Privacy Policy describes how we collect and use personal information. By using the site you consent to the collection, use and disclosure set out in the Privacy Policy.
13. Intellectual property notices & user content
If you post reviews or content, you grant us a perpetual licence to use that content for marketing (you warrant you have rights to post).
14. Termination & Suspension
We may suspend or terminate your access for breach of these Terms or for operational reasons.
15. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of New South Wales, Australia. Any dispute will be subject to the non-exclusive jurisdiction of courts in that state (replace with your chosen Australian state/territory if preferred).
